There are several regulations that must be adhered to for a will to be considered valid and upheld. For instance, in the state of Florida, the testator (maker of the will) must be at least 18 years old and be of sound mind. In addition, it must be witnessed and notarized according to Florida will laws.

Living trusts are also known as a revocable trusts, and are used as a tool to provide additional benefits that may not be available with traditional estate planning. While living trusts are not a replacement for wills, they do provide some benefits such as assisting with avoiding probate, and possibly reducing taxes after death.
